GARMIN TRUCKER TRAITORS TOTAL CROOKS, LIARS, Thugs, INCOMPETANTS CONSPIRATORS AGAINST TRUCKERS IN MY OPINION BASED ON FACTS.

Garmin is a joke and a fraud against truckers. They extort thousdan of dollars from truckers and provide a sham of a device. It is not accurate and the maps are out of date and cannot be updated as promised.

THIS DEVICE IS DANGEROUS TO THE PUBLIC AND CAN CAUSE DEATH IN MY OPINION TO HAPLESS VICTOMS MISGUIDED TO DANGEROUS LOCATONS.

1. The Plaintiff acted in good faith to settle the issues regarding the GPS device 465T with the stipulation that a replacement device would work as advertised and that any issues involving this replacement device would be resolved and that the replacement device was issued as a new device under warranty.

2. The replacement device provided was a return item from another customer and not a new device.

3. The replacement device sent came with a box and a new warranty.

4. The replacement device came with lifetime updates to the maps.

5. The replacement device will not update any new maps.

6. The defendant, garmin, was contacted numerous times and could not be reached by phone. 7. The defendant was contacted by letter on 9-11-12 and refused to respond (Exh A)

8. The defendant was contacted again on 11-20-12 and refused to address the problems with the unit sent under warranty. (Exh B)

9. The material sent with the replacement device was stated to have a warranty.

10. The defendant attorney sent a letter stating that the defendant was not obligated to send a replacement unit which worked. (Exh C)

11. The replacement unit has frozen or locked up on several situations in traffic and has caused many problems.

12. In late 2007, the Plaintiff contacted the defendant to ask is there was a unit designed for truck routing and was told no.

13. The Plaintiff went to POI Factory and downloaded numerous POI's (Points of Interest) including locations of weigh stations, low bridges, weight restriction roads, fuel stops, truck stops and some shopping areas. These POI's worked very well and were accurate.

14. The maps and POI's specific to trucks is not programmed very well on the 465 and places trucks in dangerous and risky situations not to mention routes which are costly.

15. Recently while traveling from Georgia starting on I-20 to Utah thru Memphis, Tulsa and North on I-135 to I-70, the device indicated no impediments. When the Plaintiff reached about a midpoint in Arkansas on I-40, while still receiving a green light on the GPS indicating no delays, I-40 was closed and the detour lasted 4 hours.

16. A delay to a truck cost on average at break even $1.85 per mile or $111.00 per hour or $444.00 per the 4 hour delay.

17. The Plaintiff relied on the Truck GPS 465 because it has a traffic warning system. The traffic warning system did not work and the defendant wasted 4 hours in traffic which was less than 5 miles per hour which is extremely costly to the wear and tear on a large truck.

18. The Plaintiff understands that many people who make decisions about trucks do not know anything relevant about operating a truck or the costs and even though trucks provide 100% of all consumer goods to consumers including Garmin personnel and their attorneys, these people have no regard for the quality of product they expect truckers to purchase at costs over $400.00. They merely believe that they can throw a device together with a few of the POI's and a gullible trucker will pay $400 and throw it away if it does not work.

19. The Plaintiff was entitled to a "new" GPS replacement in the settlement and was tricked into a blemished return which was returned from another customer because it did not work.

20. This stipulation and agreement was conducted in bad faith by the defendant in a fraudulent effort to get a gullible trucker to go away.

21. The Plaintiff can site dozens of problems with faulty GPS device 465 which are unnecessary and detrimental to any trucking operation.

22. Because drivers are not routinely provided with directions to a facility, it is a requirement to have a reliable GPS device.

23. Having a Gps device which locks up in the middle of traffic in a major city is an extremely costly situation. The driver needs to pass any expected turns in order to find a safe place to park a truck and get oriented. This sometimes requires over 20 miles of driving to find a trucker friendly parking place as many cities expect that the 100% of consumer goods delivered by trucks but refuse to allow trucks to park within the city.

24. Plaintiff has purchased 3 truck 465 devices none of which work properly.

26. The defendant has done a horrendous disservice to the trucking industry by claiming that they have a GPS device which is designed for trucks. This is false, fraudulent and outrageous.

27. The POI's available at POI Factory are better than the POI's in the Garmin 465 which is advertised as a state of the art trucking GPS device. The is false and this is fraud.

The device is extremely dangerous and in my opinion causes fatalities because of the total incompetance in programming and marketing.

The device continually states that many interstates are not a truck route which is absolutely inaccurate

The device rarely gives current traffice alerts and causes much delay in routing

Garmin is nothing but a bunch of THUGS................
